Rules and Regs

One of the goals of Give! 2013 is to encourage donors to discover and support multiple  participating nonprofits. To catalyze such behavior, our good friends at Heuberger Motors are donating a 2014 Subaru Crosstrek. Winner of the Vehicle must possess a valid driver’s license at the time of the drawing, to be confirmed by Heuberger Subaru after the Drawing. Read on for more details.

There are two ways to enter. Donate to at least 5 — or more — Give! 2013 nonprofits here on our website or using the form in our Give! Guide and you will be entered into the 2013 Give! Back Sweepstakes so long as you  meet basic eligibility requirements (see below).

Or you can enter without making a donation by hand printing your name, home address, day and evening phone numbers, email address (if any) and date of birth on a postcard.  Send via U.S. mail to Give! Back Campaign Sweepstakes, 235 S. Nevada, Colorado Springs, Colorado 80903.  All mail-in entries must be received by Sponsor before 11:59 p.m. on December 31, 2013.

Eligibility.  The Give! 2013 Campaign Heuberger Subaru Giveaway (referred to as the “Sweepstakes”) is only open to legal residents of the Colorado counties of El Paso, Pueblo, and Teller who are 18 years or older, are not employees (and were not at any time in 2013) of Sponsor, the Sweepstakes Affiliate, or any of their affiliates or subsidiaries, including but not limited to advertising, promotion, and other coordinating agencies involved in this promotion, or the household or immediate family members (spouses, parents, children, siblings) of any of the above.  Void where prohibited by law.

Entry Dates.  Entry for the Sweepstakes is open beginning at 12:01 a.m. Mountain Time on November 1, 2013 and ending at 11:59 p.m. Mountain Time on December 31, 2013 (the “Entry Period”).

Entry.  Participants may enter the Sweepstakes through the Give! 2013 cyber or print donation form or by mail, as provided below:

  • Donor Entry.  All eligible individuals who make a charitable contribution to five (5) or more charities through the Give! 2013 Campaign during the Entry Period may enter into the Sweepstakes.  See for additional details regarding the Give! 2013 Campaign.

  • Mail-in Entry.  No purchase or donation is necessary to enter the Sweepstakes.  To enter without making a donation, hand print your name, home address, day and evening phone numbers, email address (if any), and date of birth on a postcard.  Send via U.S. mail to Give! Campaign Sweepstakes, 235 S. Nevada, Colorado Springs, Colorado 80903.  All mail-in entries must be received by Sponsor before 11:59 PM on December 31, 2013.

  • Entry Rules.  One entry per person or address, regardless of method of entry.  Entrants are subject to the additional eligibility requirements as set forth in these Official Rules.  All entries become the exclusive property of Sponsor and Sweepstakes Affiliate.  Entrants will not receive any acknowledgment or confirmation of receipt by Sponsor.  Proof of mailing is not proof of receipt of entry by Sponsor.  By participating in the Sweepstakes, each entrant fully and unconditionally agrees to be bound by and accepts these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding entry eligibility, selection of entrants and winners, and the award of prizes).  All decisions of Sponsor are final and binding.

Sponsor; Affiliate.  The Sweepstakes is sponsored by the Give! Campaign, located at 235 S. Nevada, Colorado Springs, Colorado 80903 (“Sponsor”).  Heuberger Subaru is the “Sweepstakes Affiliate.”
Prizes and Eligibility.  One winner will receive a 2014 Subaru XV Crosstrek from Heuberger Subaru of Colorado Springs, Colorado (the “Vehicle”).  The estimated retail value of the Vehicle is $21,278 +$389= $21,667.  Winner of the Vehicle must possess a valid driver’s license at the time of the drawing, to be confirmed by Heuberger Subaru after the Drawing.

If the winner of a prize either declines the prize or is deemed ineligible by Sponsor or Sweepstakes Affiliate, then another winner will be selected in the same manner as the initial Drawing, until an eligible individual accepts such prize.

Drawing; Odds of Winning.  To determine the winners of the Sweepstakes, a drawing of all eligible entrants will be held on January 30, 2014, at the Give! Campaign offices (the “Drawing”).  The odds of winning a prize in either Drawing is dependent on the number of valid entries received.  The Drawing winner shall be selected in a random drawing under the supervision of Sponsor.  Sponsor has sole and absolute authority over all matters related to the Drawing.  No cash or credit redemption, assignment, transfer or substitution of any prize is permitted; however, Sponsor reserves the right to substitute a prize of equal or greater value should the stated prize become unavailable for any reason.

Notification; Winners List.  
Each Drawing winner shall be notified in person, by telephone, mail, or email within 15 days of the Drawing (the “Notification”).  If the Notification is returned undeliverable, the winner fails to respond within two weeks of the Notification, or the winner is otherwise deemed ineligible under these Official Rules, a new winner will be drawn.  The name of the winner will be available within 7 days of winner’s acceptance of the prize.  For the name of the winner, send your request and a self-addressed stamped envelope to Sponsor at the address provided above.

Prize Conditions.  
Prize winners are subject to the following requirements:

  • Releases.  Prize winners may be required to complete, execute, and return a Receipt and Release accepting the prize, a Hold-Harmless and Indemnity Agreement, and a Publicity Release within 30 days of Notification.  Failure to timely execute the applicable documents, to respond as required under Paragraph 7, or if winner is otherwise found to be ineligible or not in conformance with the Official Rules, winner shall be disqualified and a new winner will be drawn.
  • Publicity.  By accepting the prize, where permitted by law, winner grants to Sponsor and Sweepstakes Affiliate the unfettered right of publicity, including but not limited to the right to use and publish winner’s name, portrait, picture, voice, and likeness for advertising, trade, and promotional purposes without consideration, worldwide and on the world wide web, without notification, review, or approval.  Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds:  (1) to be tampering with the entry process or the Sweepstakes operation; (2) to be violating the terms of the Official Rules; or (3) to be acting in a manner disruptive to the Sweepstakes and other Sweepstakes participants.
  • Assumption of Risk.  In consideration for entering the Sweepstakes, each entrant agrees to assume all risks associated with acceptance, possession, use or misuse of the prize or the Drawing, and agrees to hold harmless, release, defend and indemnify the Sponsor and Sweepstakes Affiliate and their subsidiaries, agents, employees, representatives, assignees, directors, officers, partners and shareholders (each a “Released Party”) from all liabilities, litigation, and claims for injury or death to persons or damage to property arising from acceptance, possession, use or misuse of the prize, participation in any Drawing related activity, including those injuries and damages caused by a party’s alleged or actual negligence or breach of any express or implied warranty.
  • Taxes.  Each winner is solely responsible for all applicable federal, state, and local taxes.

Choice of Law.  Any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, or the determination of the winner shall be resolved individually by the American Arbitration Association, without resort to any form of class action.  All claims, judgments, and awards shall be limited to actual out of pocket expenses incurred, including those associated with entering the Sweepstakes but not including attorney fees.  Entrant waives all rights to claim punitive, incidental, and consequential damages, and any rights to have damages multiplied or otherwise increased.  All entrants contractually agree that all claims for damages, injury, or death, including all questions concerning the construction, validity, interpretation, and enforceability of the Official Rules shall be governed by Colorado Law and the exclusive jurisdiction shall be in the El Paso County District Court for the State of Colorado or in Federal Court for the State of Colorado.
